Se inaplicó el Art. 1º del Decreto 1382 de 2000 por ser manifiestamente contrario a la Constitución Política.
En consecuencia, se declaró la nulidad por violación al debido proceso y al acceso a la administración de justicia, de todo lo actuado en la tutela promovida por el ciudadano de la referencia contra los miembros de la Junta Directiva de la Asociación Nacional de Oficiales de Marina Mercante Colombiana ASOMEC, a partir del auto por medio del cual el Juzgado 20 Laboral del Circuito de Bogotá declaró que carecía de competencia para conocer del asunto.

- Primero. Inaplicar por ser manifiestamente contrario a la Constitucion Politica, el articulo 1o del Decreto 1382 de 2000.
- Segundo. Declarar la nulidad por violacion al debido proceso y al acceso a la administracion de justicia, de todo lo actuado en la accion de tutela promovida por Alfredo Otero Cifuentes, contra los miembros de la Junta Directiva de la Asociacion Nacional de Oficiales de marina mercante Colombiana ASOMEC, a partir del auto del veintitres (23) de mayo de dos mil dos (2002), incluido este, por medio del cual el juzgado veinte (20) Laboral del Circuito de Bogota declaro que carecia de competencia para conocer del asunto.
- Tercero. Ordenar al Juzgado veinte (20) laboral Circuito de Bogota que asuma de manera diligente el conocimiento de la tutela de la referencia.
